Terms and Conditions

1. General

1.1. These general terms and conditions apply to all offers, quotations, work, orders, agreements and deliveries of services and products by or on behalf of Ongediertebestrijding-Janssen.nl

1.2. By using the services and products of Ongediertebestrijding-Janssen.nl, you agree to these general terms and conditions.

2. Services and offers

2.1. Pest Control-Janssen.co.uk offers various electrical services, including installation, maintenance and repair of electrical systems.

2.2. All quotations and offers of Ongediertebestrijding-Janssen.nl are without obligation, unless explicitly stated otherwise. Quotations are valid for 30 days, unless otherwise indicated.

2.3. Ongediertebestrijding-Janssen.nl cannot be held to its quotations or offers if the customer can reasonably understand that the quotations or offers, or part thereof, contain an obvious mistake or slip of the pen.

3. Agreement

3.1. An agreement is concluded at the moment the customer accepts an offer or quotation of Ongediertebestrijding-Janssen.nl in writing or orally.

3.2. Electra-Service.nl reserves the right to refuse an order if it has reason to believe that the customer will not fulfil its obligations.

4. Prices and Payment

4.1. All prices are exclusive of VAT unless otherwise stated.

4.2. Payment must be made within 14 days of the invoice date, unless otherwise agreed. If the Customer fails to make timely payment, the Customer shall be in default by operation of law and shall owe interest of 1% per month, unless the statutory interest rate is higher, in which case the statutory interest rate shall apply.

4.3. In case of late payment, the customer shall, in addition to the amount due and the interest accrued thereon, be liable for full compensation of both extrajudicial and judicial collection costs, including costs for lawyers, bailiffs and collection agencies.

5. Performance of the Services

5.1. Ongediertebestrijding-Janssen.nl shall perform the services to the best of its knowledge and ability and in accordance with the requirements of good workmanship.

5.2. If and insofar as a proper execution of the services requires this, Ongediertebestrijding-Janssen.nl has the right to have certain activities performed by third parties.

5.3. The client shall ensure that all data, which Ongediertebestrijding-Janssen.nl indicates are necessary or which the client should reasonably understand are necessary for the execution of the services, are provided to Ongediertebestrijding-Janssen.nl in a timely manner.

6. Liability

6.1. Ongediertebestrijding-Janssen.nl is only liable for direct damage resulting from intent or deliberate recklessness of Ongediertebestrijding-Janssen.nl.

6.2. The liability of Ongediertebestrijding-Janssen.nl is limited to the amount covered by Ongediertebestrijding-Janssen.nl's liability insurance. If in any case the insurance provides no cover or does not proceed to payment, the liability of Ongediertebestrijding-Janssen.nl shall be limited to the invoice amount, excluding VAT, paid by the customer to Ongediertebestrijding-Janssen.nl.

6.3. Ongediertebestrijding-Janssen.nl shall in no case be liable for indirect damage, including but not limited to consequential damage, loss of profit, missed savings and damage due to business stagnation.

7. Force majeure

7.1.Ongediertebestrijding-Janssen.nl is not obliged to comply with any obligation towards the customer if it is hindered to do so as a result of a circumstance that is not due to fault, and neither by virtue of the law, a legal act or generally accepted practice is for its account.

7.2. In these general terms and conditions, force majeure means, in addition to what is understood by law and jurisprudence, all external causes, foreseen or unforeseen, on which Ongediertebestrijding-Janssen.nl has no influence, but which prevent Ongediertebestrijding-Janssen.nl from fulfilling its obligations.

8. Applicable law and disputes

8.1. All legal relationships to which Ongediertebestrijding-Janssen.nl is a party, shall be governed exclusively by Dutch law, even if an obligation is fully or partially implemented abroad or if the party involved in the legal relationship has its place of residence there.

8.2. Disputes between Ongediertebestrijding-Janssen.nl and the customer will exclusively be submitted to the competent court in the district in which Ongediertebestrijding-Janssen.nl is established, unless the law imperatively prescribes otherwise.

9. Amendment and Location of the Terms and Conditions

9.1. These terms and conditions have been filed with the Chamber of Commerce under number 90180100.

9.2. The most recently filed version or the version valid at the time the legal relationship with Ongediertebestrijding-Janssen.nl was established shall always apply.

9.3. Ongediertebestrijding-Janssen.nl reserves the right to amend or supplement these general terms and conditions. Changes shall also apply to agreements already concluded with due observance of a period of 30 days after written notification of the change.
